Terms of Service

Welcome to Faunify. These Terms of Service ("Terms") govern your access to and use of Faunify, including our website, mobile applications, subscriptions, and related services (collectively, the "Services"). By creating an account or using Faunify, you agree to be bound by these Terms. These Terms should be read together with our Privacy Policy.

Faunify is an animal care organisation platform designed to help users organise information relating to the care of their animals. Our Services may include pet profiles, feeding schedules, medication reminders, inventory tracking, health records, activity logs, family member access, pet sitter access, document sharing, subscriptions, and additional features released from time to time.

Faunify is intended to assist users in organising information. It is not a veterinary service or emergency care provider.

You must be at least the minimum legal age required to enter into a binding agreement in your country, or have the permission of a parent or legal guardian. By creating an account, you confirm that the information you provide is accurate, you are legally permitted to use Faunify, and you will keep your information up to date.

You are responsible for maintaining the confidentiality of your login credentials, all activity that occurs under your account, and ensuring your contact information remains accurate. You must not share your account with others except through the sharing features provided by Faunify.

The person who creates the account is considered the Account Owner and controls the animals associated with the account, subscription management, billing, invitations, and permissions granted to family members or pet sitters. The Account Owner is responsible for all activity performed by users they authorise.

Faunify allows Account Owners to invite authorised users to assist with animal care. Depending on permissions granted, invited users may view selected pets, view care information, record activities, update logs, and complete scheduled tasks. The Account Owner is solely responsible for deciding who to invite, determining appropriate permissions, and removing access when required. Faunify is not responsible for the actions, omissions or conduct of invited users.

You agree to use Faunify only for lawful purposes. You must not use Faunify in any unlawful manner, attempt to gain unauthorised access to any system, interfere with the operation or security of Faunify, upload malicious software, scrape or harvest information, reverse engineer Faunify, infringe another person's rights, impersonate another individual, misuse shared access features, or interfere with another user's use of the Services.

You retain ownership of the information you upload to Faunify, including pet profiles, photographs, reminders, health records, care logs, inventory information, and documents. By submitting content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce and display that content solely for the purpose of providing, maintaining, securing and improving the Services. This licence ends when your content is permanently deleted from Faunify, except where retention is required by law.

Unless otherwise stated, Faunify and all associated intellectual property — including the Faunify name, logos, branding, software, application design, user interface, graphics, databases, documentation, and written content — are owned by us or our licensors. You may not copy, reproduce, modify, distribute, sell or create derivative works from Faunify without our prior written permission.

Faunify may offer both free and paid subscription plans. Paid plans may include additional features, increased limits or functionality not available under the free plan. Current subscription information is displayed within the application or at the point of purchase.

Subscription payments are processed securely through Stripe or another authorised payment provider. By purchasing a subscription, you authorise the applicable payment provider to charge your selected payment method. Faunify does not store your complete payment card information.

Unless otherwise stated, paid subscriptions automatically renew at the end of each billing period until cancelled. You are responsible for ensuring your payment information remains current. If payment cannot be processed, we may suspend or restrict access to paid features. We reserve the right to change subscription pricing; where required by law, reasonable notice will be provided.

You may cancel your paid subscription at any time through your Faunify account settings. Unless otherwise required by law, cancellation will take effect at the end of your current billing period. Cancelling a subscription does not automatically delete your Faunify account or data. To permanently remove your account, follow the account deletion process described in our Privacy Policy.

Unless otherwise required by applicable law, subscription fees are non-refundable. Where subscriptions are purchased through Apple or Google, refunds are subject to the applicable App Store or Google Play policies. Nothing in these Terms limits any rights you may have under Australian Consumer Law or other applicable consumer protection legislation.

Faunify is provided on an "as available" basis. We do not guarantee that the Services will always be uninterrupted, error-free, secure or available. Access may occasionally be interrupted due to scheduled maintenance, software updates, technical issues, internet outages, third-party service failures, security incidents, or circumstances beyond our reasonable control.

We may introduce new features, remove existing features, modify functionality, change subscription inclusions, or discontinue features. Where practical, we will provide reasonable notice of significant changes. Nothing in these Terms guarantees the ongoing availability of any particular feature.

While we make reasonable efforts to deliver reminders reliably, notifications may be delayed, unavailable or fail to be delivered due to internet connectivity, device settings, operating system restrictions, battery optimisation, third-party notification services, user configuration, or software updates. You acknowledge that reminders are provided as an organisational aid only. You remain solely responsible for ensuring the timely care of your animals.

Faunify is not a veterinary practice, veterinary service or emergency animal care provider. Information stored within Faunify is entered by users and is not reviewed, monitored or verified by Faunify. Nothing within the Services should be interpreted as veterinary, medical, nutritional, behavioural or professional animal care advice. Always seek advice from a qualified veterinarian regarding the health and welfare of your animals.

To the maximum extent permitted by law, Faunify, its owners, employees, contractors and affiliates are not liable for any indirect, incidental, consequential, special or exemplary damages arising from your use of the Services. This includes missed reminders, incorrect information entered by users, data loss, unauthorised access resulting from compromised credentials, service interruptions, third-party service failures, payment processing issues, decisions made based on information in Faunify, or injury, illness or loss relating to animals.

Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot be excluded under Australian Consumer Law or other applicable legislation.

Your use of Faunify is also governed by our Privacy Policy, which explains how we collect, use, disclose, store and protect your personal information.

We may suspend, restrict or terminate your access to Faunify if we reasonably believe that you have breached these Terms, misused the Services, engaged in unlawful activity, compromised the security or integrity of Faunify, failed to pay applicable subscription fees, or used Faunify in a manner that may cause harm. Termination does not affect any rights or obligations that arose before termination.

Features identified as beta, preview, experimental or early access are provided for testing purposes and may contain bugs or incomplete functionality. Beta features may be modified, suspended or removed at any time without notice. Use of beta features is entirely at your own risk.

Faunify is not responsible for delays or failures in performance resulting from events beyond our reasonable control, including natural disasters, acts of government, internet outages, cyber incidents, labour disputes, pandemics or failures of third-party infrastructure.

By creating an account or using Faunify, you agree that we may provide notices, disclosures and other communications electronically, including by email, through the Services or by posting them on our website.

We may update these Terms from time to time. When changes are made, we will publish the updated Terms on our website and revise the "Last Updated" date. Your continued use of Faunify after updated Terms become effective constitutes acceptance of the revised Terms.

These Terms are governed by the laws of New South Wales, Australia. Nothing in these Terms limits any rights you may have under mandatory consumer protection laws applicable in your country of residence.

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be severed to the extent necessary, and the remaining provisions will continue in full force and effect.
